Surf School Terms and Conditions

1. BOOKINGS & PAYMENTS FOR SURF AND SKATE LESSONS & RENTAL OF SURF AND SKATE EQUIPMENT
* Surf lessons and Skate lessons must be booked in advance. Payment can be made afterwards.
* Surf and Skate equipment cannot be booked/reserved in advance.
* Prices for surf and skate lessons and rental of surf and skate equipment include VAT and are stated on the Hart Beach website and in its brochure.
* Hart Beach will try its best to keep the reserved date and time available. However, Hart Beach reserves the right to reschedule the booking. Hart Beach will, of course, contact the participant in good time to discuss this. Hart Beach will then propose an alternative date and time to the participant, taking the participant's wishes into account as much as possible.
* If fewer people show up than reserved for, unfortunately, no amount can be deducted from the total due. This is partly due to agreements we make with third parties. The contact person is responsible for this.
* Although the website and others declare to agree with the content of the text on the relevant board, and declare to strictly adhere to the instructions.
* If a participant has not surfed or skated before, is renting equipment (such as a surfboard or skate equipment) for the first time, or is taking a lesson, he/she must report this to Hart Beach staff so that he/she receives an explanation of the use of the equipment and/or the rules.
* It is the participant's own responsibility to receive the explanation, attend the explanation, and pay attention during the explanation.
* Hart Beach is therefore not liable for possible calamities and damages, material or immaterial, including personal injury, if the participant is not aware of what is communicated during the explanation. The participant is aware that the explanation does not guarantee that possible calamities and damages, material or immaterial, including personal injury, will be prevented, and the participant indemnifies Hart Beach for this.
* For surfing and skating, there is a minimum age of 6 years, and for surfing, a swimming certificate A is mandatory.
* It is the express responsibility of parents and/or guardians of minors to provide Hart Beach with accurate information regarding age and swimming ability. Hart Beach accepts no liability whatsoever if incorrect or incomplete information has been provided.
* The participant is strongly advised not to participate in surfing or skating if the participant suffers from neck and/or back complaints, is pregnant, has or has had heart problems, has poor physical condition, is short of breath, or is under the influence of medication, drugs and/or alcohol. Hart Beach is in no way liable for consequences if the participant concerned decides to participate in surfing or skating anyway.
* Hart Beach accepts no liability whatsoever for damages, material or immaterial, including personal injury, incurred due to (steering) errors, incompetence, collisions, cutting off, defects in the materials used (surfboards, skateboards, wetsuits, etc.), and accepts no liability whatsoever for any damage suffered by the participant and/or other participants. The participant expressly bears this risk and fully indemnifies Hart Beach.
* In the event of reckless behavior during individual surfing or skating and during surf and skate lessons, including reckless behavior while surfing or skating, during collisions, when cutting off, and when intentionally causing damage, etc., the injured party or Hart Beach may hold the participant liable for the damage suffered.
* The rented item is at the risk of the undersigned. Hart Beach BV cannot be held liable in any way for damage or accidents to third parties and the renter. Equipment is rented for a certain period. In case of damage, total loss, or theft, the undersigned will immediately pay the new price of the rented material upon return.
* The limitations of liability of Hart Beach included in these terms and conditions do not apply if the damage is due to intent or gross negligence on the part of Hart Beach.
* For groups, one person can fill in and sign the group registration form, which means that this person is liable for all participants in the group with regard to everything mentioned in the General Terms and Conditions.
* Hart Beach will perform every service to the best of its ability and is entitled to engage third parties for and in the performance of a service.
However, Hart Beach is not liable for damage suffered by the Participant or third parties as a result of an act or omission by auxiliary persons engaged by Hart Beach (excluding Hart Beach employees), even if they are employed by an organization affiliated with Hart Beach; business, indirect or consequential damage suffered by the Participant or third parties.

3. FORCE MAJEURE
Force majeure in these general terms and conditions refers, in addition to what is understood by law and jurisprudence, to all external causes, foreseen or unforeseen, over which Hart Beach has no influence, but which prevent Hart Beach from fulfilling its obligations.
* Force majeure: strikes, death, fire, transport, disruption, civil disturbance, and in general all unforeseen circumstances as a result of which compliance with the agreement can no longer be demanded from the contractor.
* Hart Beach is not obliged to fulfill any obligation if Hart Beach is hindered from doing so as a result of a circumstance that is not attributable to its fault, and which is not for its account by virtue of the law, a legal act or generally accepted views. This also applies to
certain weather conditions. In that case, Hart Beach is authorized to cancel bookings and reservations, and to propose an alternative date and time to the participant(s).

4. MEDIA AND COPYRIGHT
* Cameras and other equipment are present on the Hart Beach premises, for safety and commercial reasons. All media rights to recordings made, everything in the broadest sense of the word, remain with Hart Beach, and the participant expressly waives these rights. With regard to all services and products to be supplied by Hart Beach, Hart Beach reserves all rights and powers that Hart Beach is entitled to under the Copyright Act.


5. APPLICABLE LAW
* Dutch law applies to the legal relationship between Hart Beach and the participant. If a dispute should arise between the participant and Hart Beach, the District Court of The Hague has exclusive jurisdiction to hear disputes. Nevertheless, Hart Beach has the right to submit a dispute to the court competent according to the law.

6. Cancellation
* Hart Beach reserves the right to cancel the surf camp in unforeseen circumstances. A minimum of 10 registrations is required for the Surf Camp to proceed. If this cancellation takes place before the start of the camp, the already paid course fees will be refunded without the right to compensation.

*Anyone who does not show up without prior communication loses the total registration fee. If you cancel at least 1 month before the start of the surf camp in writing or by email, you will pay € 25,- administration costs and the costs for hotel cancellation. If you cancel within one month prior to the surf camp, you will need a doctor's certificate and you will be refunded everything after deducting € 50,- administration costs.
